This website is owned and operated by Western Cape Aquatics (WCA). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the website or our service, you approve that you have read, understood, and agree to be bound by these Terms.

Code of Conduct below:

  1. Abide by the rules of Swimming South Africa (SSA) as set out in its Constitution, the Child Protection Policy and the Safeguarding Policy.
  2. Submit my police clearance annually and refrain from all kinds of crime, including offences related to children, vulnerable people, and narcotics. SSA reserves the right to accept or reject applications and registrations based on any other criminal offences.
  3. Keep all required accreditation & registration up to date by complying with SSA’s Continuous Professional Development policy for all the members.
  4. Not endorse any illegal products and always adhere to South African Institute for Drug-Free Sport Framework and guidelines.
  5. Not endorse any product, services or promotions, commercials and advertisements unless authorized by SSA.
  6. Promote and enhance among all South Africans safe and enjoyable aquatic programs conducted by accredited & registered personnel at venues that are registered, safe & suitable for aquatic use.
  7. Enhance water safety knowledge while developing survival skills, and any other recognized aquatic discipline.
  8. Provide equal opportunity for all to learn about water safety, and other aquatic disciplines and related programs and activities.
  9. Conduct myself in a proper and professional manner so as not to bring the organization into disrepute by ensuring that all persons under my instruction/care are treated with courtesy and respect.
  10. Report any real or suspected child abuse, neglect, exploitation, or any practice that places any child at risk, according to the legal procedures guided by South Africa’s legal framework, SSA’s safeguarding and child protection policies.
  11. Not to engage in any personal relationships with participants under my care including teaching, coaching, officiating and/or travelling with teams.
  12. Report to SSA my psychological, physical or health conditions that might adversely affect the health, well-being, and safety of those in my care.
  13. Abstain from the use of alcohol, drugs or any substances which may impair my judgment while in charge of participants.
  14. Be encouraging, respectful and considerate to other coaches, participants, athletes, parents, officials, volunteers and stakeholders without any prejudice or discrimination.
  15. Report to the district safeguarding officer events, issues and/or complaints relating to non -compliance with the Code of Conduct.
  16. Uphold the ethos and pride of South Africa; the image of my organization, SSA and the teaching, coaching & officiating standard of aquatics.

I accept that Swimming South Africa reserves the right to revoke my membership, after due process, if found to have contravened any or part of the teachers, coaches & volunteers code of conduct as agreed to with Swimming South Africa.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Privacy Policy

The private information required for executing the orders placed through the e-commerce facility, namely the user’s personal information and credit card details, delivery address and telephone numbers, will be kept in the strictest confidence by Western Cape Aquatics (WCA). and will not be sold, rented  or made known to any third parties. Only the necessary information – i.e. the delivery address and contact phone number - will be made known to third parties delivering the product. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Warranties & responsibility for services and products

When we receive a valid warranty claim for a product purchased from us, we will either replace the product or credit the product. If we are unable to replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of replaced products to customer and customer will be responsible for return shipment of the product to us.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Western Cape Aquatics (WCA).. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Indemnification

You agree to indemnify and hold Western Cape Aquatics (WCA). harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Western Cape Aquatics (WCA). be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Western Cape Aquatics (WCA). assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws prevailing in the Republic of South Africa without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the Western Cape in the city of Cape Town. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
